Decision of the Basic State Prosecutor to indict the journalist Mihailo Jovovic for causing grave bodily injury to Dragan Radonjic, the driver of the mayor of Podgorica, is not convincing, especially baring in mind the findings of the court expert who established a light body injury as well as doubts on the time and manner of causing the injury.The indictment hence points more to the intention of the prosecutor to answer the political expectations of equalizing the guilt of the mayor’s son and the journalist then to an act of an independent and impartial state body.
In any case we believe that the initiated criminal proceedings against Mihailo Jovovic endanger both his right to freedom of expression, as well as the right of the public to information and if the Montenegrin courts fail to live up to the challenges posed by this case, Jovovic has an open door for protection of his rights before the European Court for Human Rights.
