Human Rights Action and Journalistic Self-Regulatory Body submitted an initiative to the Government for cooperation on a thorough reform of defamation law in accordance with the European standards of freedom of expression. Cooperation was suggested with regard to: 1) organisation of a regional round table where the best European practice of implementation of standards established in the case-law of the European Court for Human Rights in domestic legal order would be discussed; 2) draft legal reform; 3) public debate on the draft reform.
Human Rights Action has appealed to the Supreme Court in September 2009 to ensure implementation of standards from the case-law of the European Court for Human Rights especially in the area of freedom of expression. As that did not happen to date, we have concluded that the appropriate amendments to the law would be the only way to secure implementation of those standards in Montenegro. HRA has in the past years actively commented the judgements that in our opinion were not in accordance with the case-law of the Strasbourg court.
