26/02/2025DECISION OF THE AGENCY FOR THE PREVENTION OF CORRUPTION: JUDGE ŠĆEPANOVIĆ VIOLATED THE LAW, CONFLICT OF INTEREST ESTABLISHED
The Agency for the Prevention of Corruption has determined that Constitutional Court Judge Budimir Šćepanović violated the Law on the Prevention of Corruption by failing to recuse himself from the Constitutional Court session on December 25, 2024, where a decision was made on whether he met the conditions for the termination of his judicial office.
The Agency has warned the Constitutional Court of Montenegro of its obligation to prevent the execution of the decision on the termination of his office.
The decision was made after the Agency acted ex officio, following an initiative from HRA dated December 26, 2024, to examine whether Judge Šćepanović participated in discussions and decision-making on matters of his private interest without first seeking ASK’s opinion or recusing himself from the proceedings.
An administrative dispute against ASK’s decision may be initiated within 20 days.
