The Constitutional Court of Montenegro today unanimously adopted constitutional appeals due to ineffective investigation of the police torture of Branimir Vukčević and Momčilo Baranin in Podgorica Jewelers’ street on the eve of 24 October 2015 political protests. The appeals were filed by Tea Gorjanc Prelević, HRA executive director.

“These decisions are of historical importance for the protection of human rights in Montenegro. For the first time, the Constitutional Court found a violation of the constitutional prohibition of torture due to ineffective investigation. We expect that the same decisions, which can restore credibility of the Constitutional Court, follow in the constitutional appeals filed for Milorad Martinović and Tufik Softić, where the state prosecution also failed to meet the European standard of effective investigation of police torture and of attempted murder of a journalist. Today’s decisions of the Constitutional Court should instigate profound reform of the work of the State Prosecutor’s Office and Police” said Gorjanc-Prelević.
